Adding Your Terms & Conditions To Your Site's Footer

The SMS marketing landscape is ever-changing, including the compliance policies set by the carriers (Verizon, T-Mobile, and other companies that deliver text messages).

At Santhe, our most important job is helping you stay compliant with your SMS marketing. We are in constant communication with the carriers in order to know when these changes are coming, proactively implement changes to our platform, and give you as much notice as possible.

Requirements for US SMS abandoned cart flows 

  1. Have double opt-in turned on

  2. Use only 1 SMS per recipient in an abandoned cart flow 

  3. Have the SMS send within 48 hours of the triggering event

  4. Have express consent for SMS and abandoned cart messages

  5. Add disclosures to your mobile terms of service and privacy policy

If you plan to send abandoned cart reminders through your SMS program, it needs to be specified within your terms of service. The language below is an example of such a disclosure. 

“If you have opted in, the Service provides alerts, information, promotions, specials, and other marketing offers (e.g., cart reminders) from <Company Name>.”

You must also address your abandoned cart program in your privacy policy. Privacy policies must explicitly state how information is captured by the website to determine when a customer cart has been abandoned (website cookies, plugins, etc). The language below is an example. 

“The <website> uses cookies to help keep track of items you put into your shopping cart including when you have abandoned your cart and this information is used to determine when to send cart reminder messages via SMS.”
